The following terms and conditions contained in this Terms of Use Agreement (“TOU”) govern your use of, access to, and purchase of products from the European version of the Website only. License Grant.

Product Information.

Isaia is not obligated to sell products described on the Website or to make such products available in your area. We reserve the right at any time after receipt of your order to accept or decline your order in our sole discretion, even after your receipt of an order confirmation or after your card has been charged. You may not purchase any item from this Website for resale by you or any other person, and you may not resell any item purchased from this Website. The prices displayed on the site are quoted in Euro and are intended to be valid only within the countries members of European Union and the United Kingdom. If a product is listed at an incorrect price, we have the right to refuse or cancel orders placed for the product listed at the incorrect price, regardless of whether the order has been confirmed or your card charged.

Governing Law.

This TOU has been made in and will be construed and enforced in accordance with the Italian laws as applied to agreements entered into and completely performed in Napoli. You agree to the personal jurisdiction by and venue in courts in the City of Napoli, Italy and waive any objection to such jurisdiction or venue.

Enforcing Security on the Website.

Actual or attempted unauthorized use of the Website may result in criminal and/or civil prosecution. Isaia reserves the right to view, monitor, and record activity on the Website without notice or permission from you, including, without limitation, by archiving communications sent by you through the Website. Any information obtained by monitoring, reviewing, or recording is subject to review by law enforcement organizations in connection with the investigation or prosecution of possible criminal or unlawful activity on the Website as well as to disclosures required by applicable law or related government agency actions.

In addition, Isaia may immediately terminate your access to the Website in the event of any conduct by you which Isaia considers to be unacceptable, or if you breach this TOU. The provisions concerning Isaia's proprietary rights, user Submissions, disclaimers of warranty, limitations of liability, waiver and severability, entire agreement, and governing law will survive the termination of this TOU for any reason.

Waiver & Severability.

The failure of Isaia to exercise or enforce any right or provision of the TOU will not constitute a waiver of such right or provision. If any part of this TOU is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most clearly matches the intent of the original provision and the remainder of this TOU shall continue in effect.

Entire Agreement.

This TOU represents the entire agreement between you and Isaia with respect to use of the Website, and supersedes all prior or contemporaneous communications between you and Isaia with respect to the Website. You may not assign or transfer any rights under this Agreement without the prior written consent of Isaia.
